Normal halde caiz olmayan bazı şeyler vardır ki, zaruret halinde meşru olmaktadır. Meselâ, vefat eden hamile bir annenin karnındaki çocuk canlı olup hareket ederse, âlimlerin çoğunun görüşüne göre, annenin karnı sol tarafından yarılır ve çocuk alınır. Çünkü bu durumda ölünün bir parçası alınsa da, başka bir canlının hayatı kurtarılmış olmaktadır.1
İşte bu fıkhî hükme istinaden zamanımız âlimleri organ nakline cevaz vermektedir. Burada bir hastayı ölümden ve herhangi bir organını kaybetmekten korumak için,ölmüş olan bir kimsenin organlarından birisi çıkarılıp hastaya takılmaktadır.Bu ameliyat daha çok böbrek,kalp ve göz gibi âzalarda yapılmaktadır.
Bu meseleye genişçe temas eden Ezher ulemâsından Ahmed eş-Şirbâsî, bu ameliyatı yaparken bazı esasların göz önünde bulundurulmasını ve onlara riayet edilmesini şart koşmaktadır. Her şeyden önce bu “nakil” hayatî bir zaruretten dolayı yapılmalıdır. Umumî mânâda bir çeşit tedâvidir. Çünkü zaruretlerin bazı haramları mubah kıldığı,bilinen bir kaidedir.
Böyle bir zaruret hâli ortaya çıkınca,hastanın mâruz kaldığı hayatî tehlikenin ancak bu yolla giderileceği teşhisinin konmuş olması; bu ameliyattan sonra da hastanın ya da tam olarak veya galip bir zanla kurtulma ümidinin tespit edilmesi gerekir. Yâni,ameliyat hem son çare olmalı,hem de kurtulma ümidi “kesin”e yakın bulunmalıdır.Tabiî,bu teşhiste sıradan kimselerin değil de,sahasında uzman bir doktorun veya varsa sağlık heyetinin karar vermiş olması lâzımdır.
Kalbi,böbreği veya gözü alınacak ölünün hayatta iken organlarını bağışlamış olması veya gerektiğinde alınabileceğine dâir muvafakatının mevcut olması da icap eder.Şayet ölen kimse hayatta iken böyle bir şey söylememiş,bir muvafakatta bulunmamışsa,yakınlarının veya varislerinin rızası alınmalıdır. Ayrıca ölmüş kişi, “Ben ölünce cesedime dokunmayın” şeklinde bir vasiyette bulunmuşsa,bu vasiyete riayet edilmelidir.
Bu meselede İslâmiyetin nazara aldığı mühim husus,insan hayatının kurtarılmasının hedef alınmış olmasıdır.Çünkü dinin esaslarından birisi de “hayatı muhafaza”dır. Bir kişinin hayatının kurtulmasına vesile olmanın bütün insanları hayata kavuşturmak kadar mühim olduğunu bildiren âyetin meâli ise şöyledir: “Kim bir kimseyi bir cana veya yeryüzünde bozgunculuğa karşılık olmadan öldürürse bütün insanları öldürmüş gibi olur. Kim de bir insanı ölümden kurtarırsa bütün insanları ölümden kurtarmış gibi olur.”2 Bu gayeye uygun olduğu içindir ki, müteahhirîn âlimleri hastaya ve çok kan kaybına uğrayan kimseye kan naklinin caiz olduğunu belirtmişlerdir. Hattâ alınan kan gayrimüslimden de olsa caizdir.3
Ancak her ne şekilde olursa olsun, organını bağışlayan veya böbreğini sağlığında veren, kan bağışı yapan kimse, bunların karşılığında bir para almamalı, menfaat şartı koşmamalıdır. Çünkü insan ve insanın parçaları, istenildiği zaman satılan ve menfaat temin edilen bir meta değildir. Bu itibarla, mecburiyet karşılığında bağışlanan bir organdan veya kandan ücret almak caiz olmamaktadır.
Bu vesile ile bu meselede sıkça sorulan bir hususa da açıklık getirelim:
Ölmeden önce göz ve böbrek gibi bir organını bağışlayan kimse, bu organlarının öldükten sonra bir hastaya takılmasıyla şüphesiz sevap kazanacaktır. Çünkü bu sayede başka bir insan sıhhate kavuşmuş, hayata dönmüştür. Ancak organ bağışlayan bu kimse bağışlamış olduğu ve sonra da nakledilmiş olan bu uzvunun ikinci bir şahısta gördüğü vazifeden dolayı mes’ul sayılmaz.
Şöyle ki, bir başkasından nakledilen gözle görmeye başlayan, eğer o gözle harama bakmış, bir günah işlemişse mes’uliyet kendisinedir. Ölen kimsenin bundan dolayı bir mes’uliyeti yoktur. Çünkü o adam ölmesiyle vücut elbisesinden tamamen soyulmuş, artık maddî bedenle bir irtibatı kalmamıştır.Huzurla kalın…
